This position is responsible for providing legal solutions to complex legal and business challenges to mitigate against legal risk and partner with the business. The role is focused around the delivery of reliable, accurate, timely and well-informed advice on legal issues. Key Accountabilities Provide legal guidance on matters Reduce external legal spend but attending to matters in house except where the nature of the matter is specific such as competition law etc.
Provie guidance and management to legal intern Identify and communicate potential legal risks Monitor relevance of legal documentation to ensure consistency in the different BWE regions Engage Divisional Disputes manager at an early stage on contentious matters so as to proactively resolve disputes to avoid court litigation Engage external law firms to obtain expert opinion on specialist areas of law Develop and implement good contracting practices including providing legal awareness training and creating templates Organisational awareness Internal “client” (business) management Ensure compliance with internal legal and other procedures and policies Develop and maintain relationships with internal stakeholders Participate in planned activities that are appropriate for own employee development Prioritisation and planning Apply legal principles, facts and precedents to recommend the adoption of an effective, practical and proper course of actionPRIMARY OUTPUTS Provide general legal advice, including legal research Structure and negotiate the legal aspects of commercial transactions Draft and/or review and/or negotiate all agreements/tenders/bids with service providers/customers and ensure that all agreements are in line with the latest legal developments and internal Barloworld Equipment/Group policies and procedures Consult with external legal firms on the provision of specialist advisory services around various legal issues Provide input to submission papers prepared for various committees/boards and ensure all approval processes are adhered to by the business in accordance with the DOA/Approvals Framework Consult with the different lines of businesses to ensure identification and mitigation of legal risk Make presentations either in person or in writing on applicable legal and regulatory developments Provide legal training on contractual matters or applicableCANDIDATE REQUIREMENTSMinimum Required Qualification LLB Admitted Attorney in South AfricaMinimum Required Experience Minimum of eight years PQE at a reputable law firm/commercial legal environmentMinimum Required Competencies Efficient negotiation skills and capability to deal with intensive negotiation sessions Strong ethical principles Ability to effectively communicate High organisational skills Ability to examine complex problems and apply legal principles, facts and precedents to recommend the adoption of an effective, practical and proper course of action Effective drafting skills and attention to detail Ability to work in a team and also on own Ability to work under pressure and meet deadlines Computer literate (MS Office) Ability to prioritise and plan Independent judgement and good analytical skills legislation Maintain an updated library of legal precedents/templates Draft legal opinions Advise management and stakeholders on new legislation and the impact thereof on business Provide legal support to business projects Letter drafting and reviewing Supporting all lines of business Review and advise on key risk areas Assist with implementation of ongoing management of contract management system Assist business with specific projects by providing legal support Assist with effective execution of commercial transactions across the business Provide input into submission papers prepared by business for various committees/boards where necessary Make presentations on legal and regulatory developments where applicable Oversee legal matters requiring external legal assistance Review legal documentation Provide legal advice on new business initiatives and ventures
