Khazna was founded in 2012 and has grown rapidly into becoming the leading and trusted wholesale Data Center provider in the Middle East and North Africa region. Through our Data Centers, we provide industry benchmark levels of power supply and cooling services to better serve the growing need for data center operations in the UAE and wider region. We are looking for a Legal Counsel to support Khazna/Khazna NEXOPS by working on the commercial aspects of the data center business and to be surrounded by endless opportunities to learn new skills and grow in the digital and technology sector.
Key Accountabilities: Develop and direct the implementation of the function strategy ensuring alignment to divisional strategy, Khazna/Khazna NEXOPS’s vision, mission, and corporate objectives. Manage the effective achievement of function objectives through effective leadership and by setting of individual objectives. Lead any talent development initiatives for the assigned function, collaborating with discipline experts and thereby ensure the availability of talent to fit business requirements. Advises internal stakeholders on regulatory, legal and contractual issues relating to a range of technology, facilities management and data center services and initiatives.
Advises on, reviews, drafts, structures and negotiates complex commercial contracts and tenders, with a view to prevent legal exposure. That includes procurement, appointment of contractors and subcontractors, facility management agreements, equipment and systems, operations, maintenance, 3rd part vendor SLA agreements, internal agreements, change requests, variations, escalation procedures, fibre connectivity and networking. Ensures the provision of subject matter expertise for the commercial, sales procurement, manpower/employment requirements and operations (corporate, facility management, etc) of the company and provides counsel to all relevant stakeholders (including leadership) on all related areas.
Ensures that the contractual provisions are consistent with the statutory requirements and the company’s policies and corporate governance. Identifies legal risks and issues with respect to the projects/deals/contracts, especially as to redress, compensation, liabilities, indemnification, ownership of trademarks, ownership and processing of data, insurance coverage and identifies and uses ways to timely mitigate them. Ensures alignment from a commercial perspective with the company's strategy, vision, mission and corporate objectives. Provides training and awareness to the relevant departments as to the legal aspects of the commercial and facility management operations.
Participates in meetings with business partners and other legal team members to share updates on ongoing projects, in progress deals, and recent developments. Updates the relevant departments on the risks under the legal documentation and on ways to minimize the risks. Works on new processes to simplify or expedite how the company transacts with its counterparties. Participates in the implementation and management of change through continuous update of the systems, processes, documents relevant to the function area, taking into account the global standards and changes in the business environment and operations.
Recommend the function budget and monitor financial performance versus the budget so that the business is aware of anticipated costs/revenues, areas of unsatisfactory performance are identified, and potential areas of cost reduction or performance improvement opportunities are capitalised upon. Lead the implementation of function policies, systems, processes, procedures, and controls so that all relevant requirements are fulfilled while delivering a quality, cost-effective service in a consistent manner. Lead the management of change through continuous improvement of function systems, processes and practices taking into account global standards and changes in the business environment which demand proactive action plans.
Ensure that all function reports and documentation are prepared timely and accurately and meet Khazna/Khazna NEXOPS’s requirements, policies, and quality standards. Related Assignments: The job holder may be required to undertake additional duties, which may be reasonably expected and forms part of the function of the job. Minimum Qualifications: Bachelor’s degree in law is a must. A master's degree would be advantageous. Admission to practice in a recognized jurisdiction. Minimum Experience: 7 years of good experience of working with data centers either in private practice or in-house and be used to running high value deals. Job-Specific Skills:
Background or keen interest in technology, real estate, commercial leasing, telecommunications and/or data centers. Strong understanding of complex commercial contracts, strong in drafting and negotiating key clauses in such contracts, solid experience in risk assessment, interaction and ability to manage key stakeholders. Strong proficiency in written and spoken English. Arabic would be advantageous. Competencies: Solid background in analytical and organisational skills and attention to detail. Strong written and oral communication and problem-solving skills. Risk assessment capabilities. Ability to continuously network, nurture relationships and gather information on new developments on data centers, cloud computing and technology.
Proactive attitude and approach to managing projects and leading initiatives, including the ability to balance multiple matters simultaneously and determine when and how to prioritize. Confidence to work effectively and with minimal supervision on matters that require significant collaboration with key stakeholders. Integrity and discretion handling and advising on confidential or sensitive information.
