We are looking for diverse top-notch individuals to join the Mercedes-Benz Team and uphold these hallmarks.Job OverviewThis position is primarily responsible for successfully managing and overseeing the Mercedes-Benz USA portfolio of matters related to lemon law, breach of warranty, and consumer claims.Responsibilities Manages a large docket of lemon law, breach of warranty, and consumer litigation claims. Provides guidance to internal business units on topics involving lemon law, Song-Beverly, Magnuson-Moss, breach of warranty, product defect, and other consumer claims. Keeps legal management and business teams apprised of significant lawsuits and legal issues; works with business teams on root cause analysis of lawsuits and legal issues Provides guidance to MBUSA's internal business units in order to effectively resolve customer claims and ensures they are properly informed of legal issues relating to their activities. Develops proactive strategies to evaluate claims and creates processes for the cost-effective and strategic resolution of litigation and pre-litigation claims. Creates measures to control costs, comply with operating budgets, and review and approve outside counsel costs. Works with team members, customers, dealers and service providers to de-escalate and resolve disputes Works with legal and business teams on how to reduce risk Manages class action, product liability, and other legal and risk management topics as requested. Maintains sufficient familiarity of class action, antitrust, tort, warranty, consumer protection, advertising, and product liability laws to effectively address legal matters and inform our business partners. Responsible for coordinating discovery responses, preparing and identifying appropriate witnesses, appearing on behalf of the company in connection with legal matters, implement strategy, controlling outside counsel expenses, and coordinating litigation strategy with colleagues from around the business. Effectively guides and leads interdisciplinary and/or international working groups and teams. Supervises non-lawyer staff members to support legal work as required. Performs legal research as necessary and documents findings via formal memorandumQualifikationenQualifications And Education Law degree from an accredited law school Bar certification (preferably in California or Georgia) 5+ years of litigation experience in the areas of lemon law, warranty and/or consumer litigation. Experience with California lemon lawsuits as well as Song-Beverly and Magnuson-Moss litigation strongly preferred. Preferred experience working for or with manufacturers (particularly in the automotive industry) to address Song-Beverly, Magnuson-Moss, breach of warranty, class action, product defect, and other consumer claims. Ability to successfully manage a high-volume of matters and provide reporting and insights on these topics. Effective and persuasive oral and written communication skills. Strong interpersonal and presentation skills, along with the ability to communicate effectively with others at all levels of the organization.Knowledge and Skills Ability to understand and communicate company policies to employees and third parties and to effectuate corporate objectives. Ability to develop and maintain good working relationships. Excellent organizational and time management skills. Good understanding of legal costs, budgeting processes and expense controls to manage outside counsel and legal expenses where appropriate. A willingness to learn about company products, activities, structure, and third-party business relationships. Strong attention to detail with above-average multi-tasking skills and the ability to adapt quickly to situations that require immediate transition. Willingness to travel to represent the company’s interests for litigation activities and other business activities. Ability to work in person on a “hybrid” or other schedule as determined by corporate policy or business needs at Mercedes-Benz USA.
