Trump's Appeal of His New York Convictions Highlights the Absurdity of Alvin Bragg's Convoluted Case

Five months before the 2024 presidential election, a Manhattan jury convicted Donald Trump of falsifying business records with the intent to conceal "another crime." On Monday, the president's lawyers asked a New York appeals court to overturn those convictions, arguing that they were based on fallacious legal theories, inadequate evidence, and fragrantly deficient jury instructions. All of those arguments are compelling. Manhattan District Attorney Alvin Bragg "concocted a purported felony by stacking time-barred misdemeanors under a convoluted legal theory," Trump's 96-page appeal brief says. "This case should never have seen the inside of a courtroom, let alone resulted in a conviction." You need not be a Trump supporter to agree with that assessment. You only have to examine the iffy logic of Bragg's case against Trump, which transformed a single hush payment into 34 state felonies. Prior to the 2016 presidential election, Michael Cohen, then Trump's personal lawyer, paid porn star Stormy Daniels $130,000 in exchange for a nondisclosure agreement (NDA) that barred her from talking about an alleged sexual encounter with Trump at a Las Vegas hotel in 2006. As Bragg told it, the effort to keep Daniels quiet was the essence of Trump's crime. By depriving voters of information they might have deemed relevant in choosing between Trump and Hillary Clinton, Bragg said, Trump committed "election interference," which the D.A. described as "the heart of the case." Bragg's underlings told the same story during Trump's trial. "This was a planned, coordinated, long-running conspiracy to influence the 2016 election, to help Donald Trump get elected through illegal expenditures, to silence people who had something bad to say about his behavior," lead prosecutor Matthew Colangelo said. "It was election fraud, pure and simple." In reality, there was nothing "pure and simple" about Bragg's case. Since trying to hide embarrassing information is not a crime, he focused on what happened after the election, when the Trump Organization reimbursed Cohen for the NDA payment with a series of checks that were recorded—inaccurately, according to Bragg—as "legal expense[s]" under a "retainer" agreement. Bragg treated each of the 11 invoices, 11 checks, and 12 ledger entries associated with the payments to Cohen as a distinct violation of a New York law against "falsifying business records" with "intent to defraud." Trump argued that he had no such intent, since there was no evidence that he tried to deprive anyone of money, property, or "anything else of pecuniary value." His appeal reiterates that argument, saying the trial judge erred in ruling that "intent to defraud either the voting public, the government, or both" was good enough. In any event, Trump's lawyers say, "no evidence suggested that the internal business records here—invoices, checks, and ledger entries—were intended to be seen, or had any reasonable prospect of ever being seen, by any governmental entity." Nor does it seem possible, let alone plausible, that those records, which were produced after Trump was elected, were aimed at deceiving "the voting public." Even assuming Trump had an "intent to defraud," falsification of business records is usually a misdemeanor, meaning the statutory deadline for prosecuting it would have passed by the time Trump was indicted in April 2023, more than five years after the last payment to Cohen. Bragg avoided that obstacle by alleging that Trump's "intent to defraud" included "an intent to commit another crime or to aid or conceal the commission thereof," which turned those 34 misdemeanors into 34 felonies. What was the other crime that Trump allegedly tried to conceal? For a year after the indictment, Bragg was vague on that point. But by the end of Trump's trial, which ran from April 15 until May 30 last year, prosecutors had settled on New York Election Law Section 17-152, an obscure, rarely used provision that makes it a misdemeanor for "two or more persons" to "conspire to promote or prevent the election of any person to a public office by unlawful means." That theory raised another issue: What "unlawful means" did Trump and Cohen use to influence an election? Amazingly, prosecutors never offered a definitive answer to that question. Instead the jurors were instructed that they could find Trump guilty based on any of three possibilities. The leading contender was a violation of the Federal Election Campaign Act (FECA), based on the theory that Cohen's payment to Daniels qualified as an excessive campaign contribution. Cohen had accepted that theory under a 2018 federal plea agreement that also resolved several other, unrelated charges against him. But the law on this point is hazy, and Trump was never charged with violating FECA by soliciting Cohen's "contribution." Furthermore, FECA expressly preempts state law, making it doubtful that a FECA violation could count as "unlawful means" under Section 17-152. "By its terms, FECA squarely preempts that application of Section 17-152 to campaign contributions to candidates for federal office," Trump's lawyers say. "Were it otherwise, any district attorney in New York (or any other State) could prosecute any alleged violation of FECA by packaging it as a violation of a state law like Section 17-152, even where, as here, federal authorities declined to pursue the alleged violation." If the jurors had doubts about the FECA theory, they were told, they could still convict Trump if they concluded that Cohen had falsified bank records when he paid Daniels. Alternatively, they could focus on the 1099-MISC forms that the Trump Organization prepared in connection with the payments to Cohen, which allegedly violated city, state, and federal tax law by misrepresenting a reimbursement as income. That last option involved a strange sort of tax fraud, since the effect of the alleged misrepresentation was to increase Cohen's tax liability. And it was a mystery how 1099s issued after the 2016 election could have retroactively affected its outcome. Because the prosecution offered three different theories of "unlawful means," it was not clear which one persuaded the jurors. In fact, it is possible that some jurors favored the FECA theory, some bought the bank-record argument, and others preferred the tax theory. Those jury instructions were clearly improper, Trump's lawyers argue. "New York law requires that the jury unanimously agree on the 'unlawful means' because the object of a Section 17-152 conspiracy is an element of the offense," they say. And even if the statute is not read that way, they add, "convicting President Trump absent such unanimity" would violate his right to due process. The appeal raises other issues, including the judge's alleged bias and the use of evidence regarding Trump's "official acts" as president. But the weak links in Bragg's case—including the conversion of a misdemeanor into a felony by reference to another misdemeanor, which in turn hinged mainly on an alleged violation of a federal election law he had no authority to enforce—would have been enough to deter any reasonably prudent and conscientious prosecutor. When you add the uncertainty about what the jury actually concluded, Trump's prospects on appeal look pretty strong.

As the motorcyclist reached speeds of nearly 150 miles an hour, tailed by a phalanx of police cars on the 210 Freeway, he was putting distance between himself and the home where, according to authorities, he had just shot and killed a sheriff's deputy. With viewers watching on live television Monday afternoon, he easily evaded a motorcycle officer who tried to stop him. He appeared to lift both hands off the handlebars as he pulled the slide back on a gun. His attempt at a quick escape ended when he plowed into a gray Toyota Camry, flipping over the front of his bike and launching him at least 10 feet in the air. It quickly emerged that the driver of the Camry was a San Bernardino County narcotics deputy who was off duty when the pursuit started, went back on duty and deliberately swerved into the motorcyclist, later identified as 47-year-old Angelo Jose Saldivar. Saldivar was captured by television cameras sitting up on the pavement before being airlifted to a hospital, where he was in stable condition Tuesday. He is expected to be charged in the coming days in the death of San Bernardino County Sheriff's Deputy Andrew Nunez, 28, who had worked for the department for six years and leaves behind a 2-year-old daughter and a pregnant wife. Three policing experts told The Times that the deputy who ended the pursuit was probably justified in using deadly force because the motorcyclist was a suspect in a homicide and posed a threat to the public. "In this case, they could have shot or used whatever means necessary to prevent further injury or loss of life without harming others," said Greg Meyer, a use-of-force expert and a former captain with the Los Angeles Police Department. It's unclear how the deputy got involved in the pursuit or when he notified the department he was back on duty. Many law enforcement officers carry their handheld radios off duty and turn them on if there's police activity nearby, Meyer said. Sheriff's officials have not identified the deputy and declined to make him available for interviews on Tuesday. Nunez was among the deputies who responded to a domestic violence call at 12:37 p.m. at a condominium on Hollyhock Drive in Rancho Cucamonga, where a man with a gun was reportedly threatening a woman. When deputies arrived, Saldivar immediately opened fire and struck Nunez in the head, killing him, according to sheriff's officials. Sheriff's officials did not provide more information on Tuesday about the domestic violence call that brought deputies to the condominium. San Bernardino County Superior Court records show that Saldivar and his wife finalized a divorce in August. As deputies rendered aid to Nunez, Saldivar fled on a motorcycle, Sheriff Shannon Dicus said. He sped east on the 210 Freeway into Upland before smashing into the Camry near Campus Avenue, authorities said. Ed Obayashi, a Modoc County sheriff's deputy and legal advisor to police agencies, said that although it's "highly unusual" for an off-duty deputy to intervene in a high-speed chase, his actions probably fall within established legal precedent. In April 2007, the U.S. Supreme Court ruled in favor of a deputy in Georgia who terminated a high-speed pursuit by pushing his bumper against the back of the other car, causing it to drive off the road and crash. The suspect, who was left a quadriplegic, sued, alleging that excessive force had deprived him of his Fourth Amendment right against unreasonable seizure. The justices held that the man's flight from police created a substantial and immediate risk of serious physical injury to others and that the deputy's attempt to terminate the chase was objectively reasonable. "Deadly force is appropriate when the subject presents an imminent threat of death or great bodily harm to officers or others, and the fact that his subject had already shot an officer and was fleeing in a way that endangered other motorists is likely to meet that standard," Seth Stoughton, a University of South Carolina law professor and former Florida police officer, said of the San Bernardino County deputy's actions. A sheriff's spokesperson did not know whether the department is conducting a use-of-force investigation. Obayashi predicted that the deputy's actions would be found to be within department policy. "He just shot a cop, and it is reasonable to assume he will shoot others, including pursuing officers," Obayashi said. "No one is going to lose sleep over what happened here at the conclusion of this chase, given what had unfolded before." On Monday night, law enforcement officers and firefighters gathered outside Arrowhead Regional Medical Center to salute Nunez’s body as it was carried out of the building. A motorcade escorted the body to the San Bernardino County coroner’s office. “We’re embedded in sorrow," Dicus said at a news conference earlier that day. "Unfortunately for our department, this has happened way too often."

If Los Angeles is acting a little superstitious this week, blame it on the Dodgers. For many die-hard fans, it's simply not enough to pay upward of a $1,000 for a night at Dodger Stadium, to fly the True Blue flag on your car and at your home, to dress your dog like a member of the starting lineup. For the regular season, maybe. But this is the World Series, and that requires extreme measures. So they wear the same unwashed Dodgers shirt each game. Eat the same meal every night. Sit in the same chair the entire time (even when the game lasts more than six hours). Pray to a Dodgers altar that features a Vin Scully bobblehead, a 1953 World Series program and a photo of Jackie Robinson signing his first contract. There is that certain hat. That certain song. That certain bar. A lucky spoon. Every bit helps, right? For Altadena resident Tom Horner, it was a votive candle that was not allowed to go out during Monday night's marathon game. "This candle is the candle they got after the magic of Freddie Freeman winning the World Series," Horner told The Times, referring to Freeman's extra-inning grand slam last year to take Game 1 against the New York Yankees. Horner didn't get home until the third inning, but the candle was already lighted, and the Dodgers had a lead. He said he made sure it stayed lighted until the end, when Freeman hit another walk-off home run. He said he couldn't confirm the candle's potency in ensuring the win, but other fans, such as Javier Chavarin of Fremont, think they're doing the trick. In a note replying to The Times after we asked fans about the superstitions they observed to help the Dodgers win, Chavarin said that his pet was a key player for the Boys in Blue. "Every time the opposing team has a runner at third base and less than two outs, I take my dog outside to pee," Chavarin wrote. "I started doing this last year, and believe it or not, over half the time the opposing team does not score." Bernard Ohanian, a resident of Washington, D.C., said his ritual to help the Dodgers win is to avoid them altogether. If he watches a live game, experience tells him the Dodgers will lose, and he can't take that risk. That made him one of the few fans to sleep soundly Monday night. On Tuesday morning, he said he rolled over in bed, took a deep breath and reached for his phone — confirming the victory. He then spent the rest of the morning catching up on all the details he missed. The last time he saw a game in person was Game 7 of the 1988 National League Championship Series against the New York Mets. Staff Reporter THE United Nations World Food Programme (WFP), in partnership with the Capricorn Foundation and Development Aid from People to People (DAPP), has strengthened food and nutrition security in the Omusati region through a community-based agricultural initiative that is empowering local farmers. The organisations visited farmers in Outapi and the Anamulenge constituency this week to observe the progress of their joint project, which aims to enhance local food systems and improve household nutrition. Since January, the initiative has supported 120 farming families to establish small-scale agricultural projects. Participants have received training, seeds, irrigation equipment, and tools to grow a range of nutritious crops for both household consumption and local market sales. Photos: WFP Namibia According to WFP, the project is now providing access to healthy food for over 900 community members, including children, pregnant and breastfeeding women, and people living with HIV and tuberculosis. WFP Namibia Country Director Naouar Labidi commended the collaboration, saying the Capricorn Foundation’s continued commitment to strengthening Namibia’s food systems “makes a meaningful difference.” “This partnership reflects our shared vision of empowering communities to become self-reliant and resilient in the face of challenges such as drought,” Labidi said. During the site visit, representatives from WFP, the Capricorn Foundation, and DAPP toured flourishing household gardens and engaged with the farmers benefiting from the project. Capricorn Foundation Head Veripura Muukua said the success of the project demonstrates the power of partnerships. “Together with WFP and DAPP, farmers are empowered with the right tools, skills, and market linkages to improve food security, build sustainable livelihoods and stronger communities,” Muukua said. Farmers in Outapi are already seeing results. Luise Mpingana, one of the participants, said the support has transformed their ability to grow food. “Before this project, we struggled to grow enough food for our families. With the training and tools we received, our gardens are thriving. We can now feed our children healthy food and even earn an income from selling what we grow,” she said. The project is jointly funded by the Capricorn Foundation and the World Food Programme, with DAPP Namibia leading implementation on the ground. DAPP provides hands-on training, installs key farming infrastructure such as shade nets, and conducts regular follow-ups to ensure long-term sustainability. WFP is the world’s largest humanitarian organisation, providing food assistance to save lives in emergencies while helping communities build resilience against conflict, disasters, and the effects of climate change.

Suspected 'Shade Snatchers' linked to more than $2.6 million in stolen eyewear arrested

Members of a sophisticated burglary crew suspected of executing a series of smash-and-grab retail burglaries that netted more than $2.6 million in stolen goods this year have been arrested, the Los Angeles Police Department said Tuesday. Three adults and three minors were arrested in connection with the burglaries at high-end eyewear and sunglass shops throughout Los Angeles and Orange counties, the statement said. From February to July, the suspects known to police as "the Shade Snatchers" hit shops in Los Angeles, Manhattan Beach, Venice, Newport Beach, La Jolla, Pasadena, Beverly Hills and Studio City, according to police. During an April 1 burglary at Good See Co. in Venice, the suspects allegedly walked away with $800,000 in goods. At a Hall of Frames Inc. in Los Angeles on Feb. 9, the suspects are accused of taking more than $300,000 in merchandise. At least 20 incidents have been linked to the group, authorities say. The LAPD's organized retail task force and gang and narcotics unit worked with local police agencies, including in Newport Beach, Pasadena, Alhambra, Beverly Hills and San Diego. According to detectives, the crew followed a similar pattern during the burglaries. Using stolen vehicles, usually older SUVs or pickup trucks, burglars crashed through storefronts during early morning hours. Carrying laundry baskets or storage bins, they would rush in to grab designer eyewear, handbags and other merchandise before fleeing in coordinated convoys of vehicles. In all, officials suspect the crew took about $2.68 million in stolen goods and caused nearly $500,000 in property damage, according to the statement. Several vehicles used appeared to have been taken from South Los Angeles neighborhoods hours before the burglaries, and some vehicles that picked up the suspects were seen in multiple crime scenes. Police used surveillance footage and other forensic evidence to help link similar vehicles to the crew. Police identified three primary adult suspects: Phillip T. Harris, 37, of Bellflower, Orlando D. Neal, 37, of Los Angeles and Rasheed Reed, 25, of Compton. The three minors who were arrested were not identified. Authorities filed 26 counts of burglary and grand theft along with firearm-related charges against the suspects. Police still are working to identify additional suspects.

Ohio Secretary of State Frank LaRose announced he has found more than 1,000 noncitizens who “appear to have registered to vote unlawfully in Ohio,” and all of them, 1,084 individuals, have been sent to the DOJ to face prosecution. “Ohio has earned its reputation as the Gold Standard, and our Election Integrity Unit continues to prove why,” he told Fox News Digital. “We work tirelessly to ensure that every eligible voter’s voice is heard, and anyone who tries to cheat the system will face serious consequences.” He noted 167 of the individuals appear to have actually cast a ballot in a federal election, and there were 135 others referred for “other unlawful voting activity.” Some of those allegedly voted in two locations in Ohio, or in two states, in the same election. Several appear to have voted “after the date of their death.” The work is part of LaRose’s plan to clean up Ohio’s voter rolls, launched before the 2024 vote. Part of that work included his lawsuit against Joe Biden because of his administration’s refusal to provide data that could have back then helped identify those in various schemes. The report explained his office also took more than 155,000 names on voter registration rolls because they were abandoned or inactive. The report explained the names came up when investigators cross-checked lists provided by the Ohio Bureau of Motor Vehicles, the Department of Homeland Security’s Systematic Alien Verification for Entitlements database, the Social Security records and more.

Street parking is generally not permitted on a Costa Rica’s national roads

RICO’s Q — Over the last ten days, the Policia de Transito, the national traffic police, have been conducting sweeps along Avenida 2 of the Ruta 121 or the “old road to Escazú” in Santa Ana’s central district. They’ve been targeting parked cars, sometimes on both sides of the one-way street. Street parking in Costa Rica can be a mixed bag, depending on where you are. In bigger cities like San José, it’s pretty common to find street parking, but don’t expect it to be easy or free. Most street parking spots are paid zones, especially in commercial areas. You’ll usually see parking meters. In Santa Ana, there are no such meters, and street parking is totally free. You can park basically anywhere outside the marked ‘yellow zones’ or official “No Estacionar” signs—those mean no parking. If you leave your car illegally parked, the fine is ¢61,000 colones, and confiscation of license plates and/or towing by the Policia de Transito is a real risk. In short, street parking in Costa Rica is doable but comes with some local quirks—pay attention to signs, keep change handy (in cities like San José, parking meters are operated via an app), and always park responsibly to save yourself from fines or towing. When it comes to national roads, that’s where it gets interesting. Though the local municipality enforces parking, its authority is on town roads and not national roads like the Ruta 121. For that, we have to refer to the Ley de Transito (Traffic Law), which sets out that parking is generally not permitted on Costa Rica’s national roads unless specifically posted and the vehicle does not obstruct traffic. The law prohibits parking in places such as sidewalks, pedestrian crossings, near intersections, or where posted signs prohibit it. Parking in front of fire hydrants, schools, hospitals, or garages is also prohibited, among others. And that is where the confusion lies. In towns like Santa Ana that have a national road, that, other than its designation as a national road, looks and feels like any other road in the town, with potholes and all. But for the parking rule. Last week, in the afternoon hours, typically after 3:00 pm, the Policia de Transito has been out (except when it is raining) in full force, informing, at times bullying, drivers parked illegally, who, like myself, didn’t think they were parking illegally. In my case, I will normally park my vehicle in front of my pizza store. Have been doing this for some time. And never a problem. Until Wednesday, when I heard the distinct sound of a police vehicle and noticed a Transito officer behind my panel van. After a brief conversation with one of the two traffic officials, I was told to move my vehicle (to a side street) or risk having my license plate confiscated. Their warning was clear and left no room for misunderstanding. My neighbours also moved their vehicles or face the same sanction. Naturally, the Mayor of Santa Ana, Juan José Vargas, is taking the heat from drivers and commerce, although it not being his doing. Vargas recently addressed in a video on his Facebook profile the comments circulating on social media about the operations and fines issued by the Traffic Police. Vargas dismissed the posts linking him to these actions as “lies” and asserted that he has no connection with the operations, which, he stated, fall under the jurisdiction of the Ministerio de Obras Públicas y Transportes (MOPT)—Ministry of Public Works and Transportation—as they involve a national road. Furthermore, the Mayor attributed the criticism on social media to people who no longer work for the municipality and who, he said, were acting out of resentment. While researching for this article, I found some other interesting (silly, in my opinion) rules of street parking in Costa Rica: Every parked vehicle must keep the emergency brake on. In urban areas, the vehicle’s tires must be kept no more than 30 centimeters from the curb. Cargo vehicles weighing more than two tons must be wedged with the required wheel chocks. Now you know.
