Delhi HC quashes 2008 FIR against activist Prof. Madhu Kishwar

New Delhi, Oct 29 (IANS) The Delhi High Court has quashed a 17-year-old attempt to murder case lodged against social activist and academic Prof. Madhu Kishwar, observing that the FIR appeared to be a “maliciously motivated counterblast” to an earlier case that had resulted in the complainant’s conviction. Allowing the petition filed by Prof. Kishwar under Section 482 of the Code of Criminal Procedure (CrPC), a single-judge Bench of Justice Amit Mahajan held that continuing the criminal proceedings registered at K.M. Pur Police Station for offences under Sections 307, 323, 506, and 34 of the Indian Penal Code would amount to “an abuse of the process of the court.” Justice Mahajan observed that the 2008 FIR filed by the complainant was a retaliatory move against an earlier case lodged by Prof. Kishwar, which arose from the same incident on December 31, 2007. “The subject FIR appears to be in the nature of defence and a maliciously motivated counterblast to FIR No. 666/2007 for wreaking vengeance upon the petitioner,” noted the Delhi High Court. It further emphasised that the complainant in the present case had already been convicted in 2019 in connection with the same altercation. The trial court had found that the complainant and her associates had formed an “unlawful assembly” and assaulted Prof. Kishwar and her driver, Sheeshpal, when they were documenting illegal encroachments in the area. It recorded that tangible evidence had been produced showing the complainant’s involvement in violent conduct and said, “There is evidence to show that each of the accused persons, including Respondent No. 4, actively participated in the use of criminal force against the petitioner, with an object to prevent the petitioner from clicking photographs and from obstructing the accused persons’ illegal encroachment.” The trial court had concluded that the accused persons’ acts amounted to rioting and assault, with the medical evidence corroborating the injuries sustained by the victims. In light of the above findings, the Delhi High Court held that reviving or continuing the 2008 proceedings would serve no legitimate legal purpose. “In such a factual background, setting the criminal law machinery in motion only for the reason that the complaint discloses commission of a cognizable offence would be an abuse of the process of the court,” Justice Mahajan observed. He further added: “Even if the allegations of the complainant are taken at the highest, considering the complainant’s conviction in a case arising out of the same incident, the same can at best be considered as self-defence or an altercation at the stage when the complainant has formed an unlawful assembly and caused injuries to the petitioner and another person when they were carrying out certain functions assigned to them.” The Delhi High Court, relying on several landmark Supreme Court judgments, concluded: “In view of the above, the present petition is allowed. Accordingly, FIR 162/2008 and all consequential proceedings arising therefrom are quashed.”

Bengaluru, Oct 29 (IANS) Amid the ongoing leadership row in Karnataka’s ruling Congress, former Congress MP D.K. Suresh, the younger brother of Deputy Chief Minister and state party President D.K. Shivakumar, on Wednesday said that his brother will become the Chief Minister if that is in his fate. “Even I wish to see my brother Shivakumar as the Chief Minister. If it is written in his fate, he will become the CM. It is not possible to make everyone happy all the time,” Suresh told media persons here. Reacting to Chief Minister Siddaramaiah’s statement in a television interview expressing his desire to lead the party in the next Assembly elections, he said: “Leaders aged 95 years and 98 years are still active in politics. Considering that, there is nothing wrong if Siddaramaiah contests the 2028 election. The next election will be fought under his leadership, and he is our leader.” Asked about reports of a “November Revolution” within the ruling Congress, Suresh said: “I have no information about any November Revolution. The Congress party has received a mandate from the people to govern for five years. Including independents, the party currently has the support of 140 MLAs in the state Assembly. What is important now is to fulfil the assurances given to the people.” He added that the party and government are functioning unitedly and that there is no confusion in governance. On AHINDA leaders organising conventions and Shivakumar’s busy schedule with party work, Suresh said: “Shivakumar is the state President of the party. It is his duty to take everyone along and treat them equally. He must also ensure that the party’s interests are not harmed in any way, and he is conducting himself accordingly.” “Shivakumar will always abide by the decisions of the party,” he emphasised. On any power-sharing deal and a possible cabinet reshuffle, Suresh said: “AICC leaders, the Chief Minister, and the Deputy Chief Minister will have to answer that. There is nothing to worry about. If it is in his fate, he (Shivakumar) will become the CM; otherwise, it’s okay.”. Responding to a question about efforts to secure the CM’s post for his brother, he clarified: “There are no such efforts. Shivakumar is the party president and also the Deputy Chief Minister. He will always uphold the interests of the party.” Asked whether Chief Minister Siddaramaiah is indispensable for the state Congress, Suresh said: “He has all the qualities of a leader. He appears healthy and is travelling across the state, ensuring good administration. It would not be wrong if we face the next election under his leadership.” “My statements regarding the leadership issue are irrelevant. The high command and party leadership will take the final decision,” he reiterated.

A former assistant principal at a Virginia elementary school ignored multiple warnings that a 6-year-old student had a gun in the hours before he shot his teacher, an attorney for the teacher said Tuesday as trial opened in the woman's $40 million lawsuit. Abby Zwerner, a first-grade teacher at Richneck Elementary School in Newport News, was shot in the hand and chest in January 2023 as she sat at a reading table in her classroom. Zwerner spent nearly two weeks in the hospital, required six surgeries and does not have the full use of her left hand. A bullet remains in her chest. The lawsuit accuses former school administrator Ebony Parker of failing to act after four different people went to her with concerns that the student brought a gun to school. Zwerner's attorney, Diane Toscano, said in opening statements that Parker made "bad decisions and choices that day." Parker had the authority but failed to search the student, remove him from the classroom and call law enforcement, Toscano added. The shooting occurred on the first day after the student had returned from a suspension for slamming Zwerner's phone two days earlier, Toscano said. It sent shock waves through the military shipbuilding community and the country, with many wondering how a child so young could get access to a gun and shoot his teacher. "No one could have imagined that a 6-year old, first-grade student would bring a firearm into a school," Parker's attorney, Daniel Hogan, told jurors. "You will be able to judge for yourself whether or not this was foreseeable. That's the heart of this case." Hogan said that decision making in a public school setting is "cooperative" and "collaborative." He also warned of hindsight bias and "Monday morning quarterbacking." "The law knows that it is fundamentally unfair to judge another person's decisions based on stuff that came up after the fact," Hogan said. "The law requires you to examine people's decisions at the time they make them." Parker is the only defendant in the lawsuit. A judge previously dismissed the district's superintendent and the school principal. Parker faces a separate criminal trial next month on eight counts of felony child neglect - one for "each of the eight bullets that endangered all the students" in Zwerner's classroom, prosecutors said. Criminal charges against school officials following a school shooting are quite rare, experts say. Each of the counts is punishable by up to five years in prison upon a conviction. The student's mother was sentenced to a total of nearly four years in prison for felony child neglect and federal weapons charges.

By Mike Garcia According to AAA, the average price per gallon of gasoline in California has hit $4.66 this week, which is a staggering $1.50 more than the national average. The primary culprit? State policies. A significant portion of this price difference is due to California’s gasoline excise tax, which greatly inflates fuel costs compared to those east of the Colorado River. As of July 1, 2025, California imposes a state excise tax of 61.2 cents per gallon. This tax is indexed to inflation and automatically increases each July unless legislative action is taken to halt it. Essentially, the state claims more than sixty cents per gallon before gas stations see any revenue. Such a high tax rate is unusual. In neighboring Arizona, the state excise tax is only 18 cents per gallon. This 43-cent discrepancy explains why many drivers opt to fill up their tanks in places like Lake Havasu or Yuma before entering California. All motorists contribute the federal tax of 18.4 cents per gallon, but California’s hefty extra charge is a local burden. The central concern isn’t just the high tax but its automatic annual increase. The current law adjusts the excise tax rate each July according to inflation, which led to the rise from 59.6 cents to 61.2 cents this year. Though the term “indexation” may seem technical, the outcome is straightforward: without legislative intervention, Californians face yearly hikes. For those commuting long distances, such as nurses or delivery drivers traveling from the Antelope Valley to downtown Los Angeles, these incremental costs accumulate quickly. The real issue isn’t just how high the tax is – it’s how it’s designed to keep rising automatically. Under current law, the excise rate adjusts each July based on inflation. That’s why it rose from 59.6 cents to 61.2 cents this year. The term “Indexation” may sound technical, but the result is simple: Without a deliberate vote from the legislature, Californians pay more every year. For a nurse or delivery worker commuting from the Antelope Valley to downtown Los Angeles, those pennies add up fast. Economists have long warned that per-gallon taxes on essentials are regressive, hitting working families hardest. Recent academic work confirms that gasoline taxes burden lower-income drivers most — long commutes, with high housing costs forcing people to drive further to work just to afford a home. The further you drive, the harder the taxes bite. Supporters of the current system claim that high taxes are the price of good roads. But even Sacramento’s own budget analysts have noted the imbalance: According to the Legislative Analyst’s Office, every one-cent cut in the gasoline excise tax reduces state revenue by just 0.05% of total state spending — a tiny fraction of the budget. And what do Californians get for that money? Not much. The Reason Foundation’s latest report ranks states on 13 measurable categories — from pavement and bridges to congestion and efficiency. The results are telling: North Carolina charges about 40.3 cents per gallon and ranks first in overall highway performance; Tennessee charges about 27.4 cents and ranks fifth — both far ahead of California, which charges 61.2 cents and ranks 49th. Clearly, how funds are spent matters more than how much is collected.

However, while the pair promised all appointments would be face-to-face, a policy document from Reform admitted that only the “vast majority [of] assessments are face to face.” A Labour Party spokesperson, responding to Reform’s welfare policy announcement, said: "Like all of Reform’s policies, their latest plan is already falling apart. “It’s no surprise Reform don’t seem to know what their own plan is on face-to-face assessments, given their welfare chief Lee Anderson was a cheerleader for the Tories when they slashed the number by over 90 per cent. Labour is increasing them. “This Labour Government is determined to offer young people hope and real opportunities. Our Youth Guarantee will ensure that 18 to 21-year-olds have a real chance of either learning or earning.” Speaking during the conference, Mr Yusuf had said: “The caseload for new claims for under-25s in this country on Pip have tripled in five years. “So we are betraying our young people. Reassessments are basically not happening anymore. These young people are … being basically tossed onto a scrap heap for the rest of their lives.” MP Lee Anderson, the party’s welfare spokesman, said: “The alarm clock generation is now being replaced by an anxiety generation. “A Reform UK Government would fully remove those with anxiety disorders but not serious psychiatric disorders from Pip eligibility. "This would save the Exchequer £3.2billion per annum based on last year's figures and we will also make sure that every single assessment is done face-to-face Instead of going to work, they are “staying at home all day, courtesy of taxpayer-funded employment support, loans and personal independence payments”, he said. The pledge came in a press conference that also saw Mr Anderson admit he used to “game the system” to help people get on benefits. The Ashfield MP explained: “Before I came into politics, I worked for the Citizens Advice Bureau. We used to fill the form out for clients… I can tell you now, we were gaming system.” He said it was “a competition” between the adviser and the Department for Work and Pensions . The former Tory added said he knew advisers at the organisation who had “a 100% hit rate” on benefits forms and could get “the fittest man in Ashfield” onto personal independence payment.

A hero soldier who overcame devastating injuries from a roadside bomb in Afghanistan before retraining as a teacher has been warned he faces jail after admitting to a relationship with a young pupil. Former Light Dragoons sergeant Simon Taylor, 43 – who broke nearly every bone in his body in the blast and later had a leg amputated - had denied allegations he became involved with the teenager at Hethersett Academy in Norfolk. The father-of-three was due to face trial at Norwich Crown Court yesterday over eight allegations, including groping her under her school skirt, touching her breasts in his car and kissing her in woods. But he admitted five offences before the start of the hearing, including sexual activity with a child while in a position of trust. The offences occurred in a two-and-a-half year period between August 2019 and January 2022. Taylor, who provided pastoral support at the school, also admitted two counts of sexual assault involving intentional touching and two counts of sexual communication with a child. Judge Andrew Shaw bailed the defendant following a defence application for a psychological report after being told of his injuries and how he had seen a comrade killed in the incident. But he warned him: ‘Don’t think just because I have ordered reports and released you on bail that immediate imprisonment has been ruled out. ‘It has not - and it remains the most likely outcome.’ Taylor, formerly of Dereham but who gave an address in court of Marston Jabbett near Bedworth, in Warwickshire was also placed on the sex offenders register. Taylor was a sergeant with the Light Dragoons and served in Bosnia and Iraq before being deployed to Afghanistan. The super-fit PT instructor was a reconnaissance troop corporal in 2009 when his vehicle hit an improvised explosive device which killed the driver, Lance Corporal Richard Brandon. The blast threw Taylor out of the vehicle and left him in a coma and multiple injuries including the broken bones, a traumatic brain injury, a collapsed lung, spinal fractures and a shattered ankle. He had a cage fitted around his spine, his shoulder pinned and arm plated, while his right leg was amputated below the knee in 2011 as a result of the injuries. He spoke previously of how he had tried to keep the leg as he ‘just wanted to be able to make a life for my family and do things with them’. 'So I kept the leg initially and they tried to pin it but it never repaired properly and in 2011 I decided to have it amputated. It was not an easy decision,’ he added. He was promoted to sergeant while working in the welfare unit and took up cycling in 2012, shortly before being medically discharged from the Army, after Help for Heroes funded a mountain bike through its grants scheme. He credited the sport with helping him to face the post-traumatic stress disorder he developed after suffering feelings of guilt for his colleague who died in the blast. ‘My first time out after receiving it, I went further in that 15-minute ride than I’d been in the last two years. I became addicted,’ he said. ‘It’s my way of helping with the psychological side of things, getting out and about in nature. It gives me the space to get my head together. ‘I only have one leg for power but when it comes to the downhill stints I’m not limited; I have a sense of freedom.’ He has used the sport to take part in high-profile fundraising events for veterans' charities, including long-distance mountain bike rides across northern England and the longest downhill cycle race in the world in the Alps. Hethersett School is a co-educational academy school with around 1,200 pupils run by Inspiration Trust, which is responsible for 21 primary and secondary schools or sixth forms. The trust said Taylor had not been employed there since July 2021. It added in a statement: 'The Trust places the highest priority on safeguarding and the protection of children and young people. All colleagues undergo rigorous pre-employment checks, including enhanced DBS screening, and are subject to ongoing safeguarding training and supervision throughout their employment. 'Where concerns arise, we work closely with statutory agencies to ensure swift and effective action is taken.' Taylor will be sentenced on January 12.

The ban on promoting, organising or running pub crawls has been extended to cover the entire area of Barcelona at all hours of the day. The new decree comes into force today, October 29. The move aims to 'ensure peaceful coexistence, safeguard residents' right to rest and protect public health'. The new decree, which also prohibits advertising related activities in any form, has been agreed following a public consultation exercise. A spokesman for Barcelona city council said: 'Pub crawling is a business that takes customers on organised drinking tours to a series of establishments that offer discounted alcoholic drinks. 'It typically involves quickly consuming one or more low-quality drinks before heading to the next stop. 'This activity has been identified as a risk factor that causes disturbances in neighbourhoods, puts extra strain on public spaces and potentially leads to criminal behaviour or road safety violations.' Pub crawls in a major Spanish city are now totally banned, whatever the time of day or night Organisers face fines ranging from €1,500 to €3,000 (£1,320 to £2,640), while participants are exempt from fines but could face them for other infractions such as drinking in the streets or causing disruptions. Until now, pub crawls were only banned in the districts of Ciutat Vella (since 2012) and L'Eixample (since June 1, 2025). The restrictions were mainly focused on nighttime hours, from 7pm to 7am. The new decree introduces a permanent ban that applies 24 hours a day, year-round, rather than being only seasonal. The new rule has been approved and will be in force for four years. According to the city council, data provided by the police indicates that the ban on alcohol routes in Ciutat Vella and L'Eixample has worked. They say it has 'contributed to significantly reducing the number of activities detected and has facilitated their prevention, thanks to the early detection of the offer through social networks'. The city council says the ban was been well-received in the Ciutat Vella district, with only three fines issued last year. Israel's military says ceasefire is back on as death toll from overnight strikes in Gaza reaches 104

Israel's military said Wednesday that the ceasefire was back on in Gaza after it carried out heavy airstrikes overnight across the Palestinian territory that killed 104 people, including 46 children, according to local health officials. The strikes - the deadliest since the ceasefire was enacted on Oct. 10 - marked the most serious challenge to the tenuous truce to date. Israeli Prime Minister Benjamin Netanyahu said he had ordered the military to conduct "powerful strikes" over Gaza after accusing Hamas of violating the ceasefire when the militant group handed over body parts that Israel said were the partial remains of a hostage recovered earlier in the war. Netanyahu called the return of these body parts a "clear violation" of the ceasefire agreement, which requires Hamas to return the remaining hostages in Gaza as soon as possible. Israeli officials also accused Hamas of staging the discovery of these remains on Monday, sharing a 14-minute edited video captured by a military drone in Gaza. In response to the Israeli strikes, Hamas said that it would delay handing over the body of another hostage. U.S. President Donald Trump, currently on a trip to Asia, defended the strikes, saying Israel was justified in carrying them out after what he said was an incident in which Hamas killed an Israeli soldier during an exchange of gunfire in Rafah, the southernmost city in Gaza. Hamas denied any involvement in that deadly shooting and in turn accused Israel of violating the ceasefire deal. Hamas has said it is struggling to locate the bodies amid the vast destruction in Gaza, while Israel has accused the militant group of purposely delaying their return. There are still 13 bodies of hostages in Gaza and their slow return is complicating efforts to proceed to the ceasefire's next phases, which addresses even thornier issues, such as the disarmament of Hamas, deployment of an international security force in Gaza and deciding who will govern the territory. Mounting death toll The Palestinian Health Ministry reported the overall death toll of 104 from the overnight strikes and said that 253 people were also wounded, most of them women and children. It said the dead include 46 children. Mohammed Abu Selmia, director of Shifa Hospital in Gaza City, said 45 people - including 20 children - were in critical condition at the hospital. He said the hospital received more 21 bodies, including seven women and six children. That's on top of the at least 60 people who were reported killed earlier. First, the Aqsa Hospital in Gaza's central city of Deir al-Balah reported at least 10 bodies, among them three women and six children. In southern Gaza, the Nasser Hospital in Khan Younis said it received 20 bodies after five Israeli strikes in the area, of which 13 were children and two were women. Elsewhere in central Gaza, the Al-Awda Hospital said it received 30 bodies, including 14 children. Trump defends Israel Trump told journalists aboard Air Force One on Wednesday that Israel "should hit back" when its troops come under attack. But he said he's still confident the ceasefire would withstand the escalation in violence because "Hamas is a very small part of the overall Middle East peace. And they have to behave." If not, they will be "terminated," Trump added. An Israeli military official said Wednesday that the soldier was killed by "enemy fire" on Tuesday afternoon targeting his vehicle in Rafah. The official spoke on condition of anonymity to discuss confidential military operations. The official said Israeli troops in the area came under attack numerous times Tuesday as they worked to destroy tunnels and Hamas infrastructure. Israel identified the soldier who was killed as Master Sgt. Yona Efraim Feldbaum, 37. Feldbaum also held U.S. citizenship. Hamas insisted it was not involved in the Rafah gunfire and reiterated its commitment to the ceasefire. "The violent strikes carried out by Israel across the strip is a blatant violation of the ceasefire deal," said the militant group, calling on mediators to pressure Israel to stop. Israel had notified the United States before launching the strikes on Tuesday, according to two U.S. officials who spoke on condition of anonymity to discuss the subject. The Israeli military said its forces struck "30 terrorists holding command positions within terrorist organizations" operating inside the Palestinian territory. It said Israeli forces would continue to uphold the ceasefire agreement but would "respond firmly" to any violation of the deal. Gaza hospitals try to cope with casualties Ambulances and small trucks carrying bodies crowded hospital entrances overnight across Gaza. In Deir Al-Balah, bodies were wheeled in on stretchers, and others carried in on mattresses. One man walked into the hospital carrying the body of a young child. "They struck right next to us, and we saw all the rubble on top of us and our young ones," said a woman standing outside of the hospital. At dawn, displaced Palestinians at the camp cleared remains of a destroyed tent next to a crater where the strike hit. They found the body of a small child and wrapped it in a blanket. "What kind of a ceasefire is this?" Amna Qrinawi, a survivor, asked. At the Al-Awda Hospital in central Gaza, scores of people gathered around dozens of bodies wrapped in white shrouds for funeral prayers. The hospital told the AP it had some 30 bodies, half of them children. Family members wept as they bade farewell to their loved ones. Among them was Yehya Eid, who said he lost his brother and nephews. He wept over a small body in a bloodied white shroud outside the hospital. "What is the reason of this? These are children who were killed. What did they do wrong? Did they fight in the war?" Eid asked, who said the strike came without warning. "These children are just like the rest of the children in the world."

TOKYO: Suzuki Motor plans to launch eight sport utility vehicles in India over the next five to six years as it looks to reclaim market share lost to rivals, the Japanese automaker’s president Toshihiro Suzuki said on Wednesday. The company is aiming to bring its share of the Indian market - currently at 38% - back to its pre-pandemic level of around 50%, even as competition is at its fiercest since Suzuki began operating in India four decades ago, he said. “India is Suzuki’s most critical market and we have big plans for India,” Suzuki said on the sidelines of the Japan Mobility Show in Tokyo. Suzuki wants to be the biggest seller of electric cars in India and maintain its lead as the country’s biggest car exporter, he added. FIGHTING OFF RIVALS, BOOSTING PRODUCTION CAPACITY The new SUVs will bring Suzuki’s total product portfolio in India to 28 models. “We are carefully bringing products and technologies to fulfill aspirations of people … from entry-level to large SUVs and MPVs,” Suzuki said. Hurricane Melissa barrelled toward eastern Cuba, where it was expected to make landfall as a major storm early on Wednesday (October 29, 2025) after pummelling Jamaica as one of the strongest Atlantic hurricanes on record. Authorities in Cuba had evacuated more than 7,00,000 people, according to Granma, the official newspaper, and forecasters said the Category 4 storm would unleash catastrophic damage in Santiago de Cuba and nearby areas. A hurricane warning was in effect for the Provinces of Granma, Santiago de Cuba, Guantanamo, Holguin, and Las Tunas, as well as for the southeastern and central Bahamas. A hurricane watch was in effect for Bermuda. On Tuesday (October 28, 2025) night, Melissa sustained winds of 215 kmph and was moving northeast at 15 kmph according to the U.S. National Hurricane Centre in Miami. “The hurricane was centred about 175 kilometres southwest of Guantánamo, Cuba, and was forecast to move across the island through the night. Provinces from Guantánamo — in the far east — to Camagüey, almost in the centre of elongated Cuba, had already suspended classes on Monday (October 27). As Cuba prepared for the storm, officials in Jamaica prepared to fan out on Wednesday (October 29) to assess the damage. Extensive damage was reported in parts of Clarendon in southern Jamaica and in the southwestern parish of St. Elizabeth, which was "under water,” said Desmond McKenzie, Deputy Chairman of Jamaica's Disaster Risk Management Council. With the milestone blow, he became only the second Indian, after Rohit Sharma, to achieve the feat. The landmark was reached when Suryakumar hit his second six of the innings, placing him among just five batters worldwide with 150 or more T20I sixes. Rohit leads the chart with 205 sixes, followed by UAE’s Muhammad Waseem (183), New Zealand’s Martin Guptill (173), England’s Jos Buttler (172), and now Suryakumar with 150*. Among Indians, only Virat Kohli (124) also features in the 100-plus sixes club. Yadav reached 150 T20I sixes in just 86 innings, making him the second-fastest batter ever to do so. Only the UAE’s Muhammad Waseem did it quicker, reaching the milestone in 66 innings, while New Zealand’s Martin Guptill took 101 innings to get the same mark. Currently playing his 91st T20I, Suryakumar has scored over 2,650 runs at a remarkable strike rate exceeding 165 and an average above 37. His total includes 21 fifties and four centuries, with a highest score of 117. Remarkably, he is the only player to have scored T20I hundreds in four different countries — South Africa, England, New Zealand, and India — highlighting his adaptability and versatility across conditions.
